SuperPark Glasgow — Terms and Conditions

These terms and conditions tell you information about us and the legal terms on which we supply Activities to you. We operate the website https://superpark.uk/. We are SP Trading SC LTD, a company registered in Scotland under company number SC855959 with our registered office at 3f1 Hill Street, Edinburgh EH2 3JP.

1. Our Contract With You

1.1 SuperPark provides access to a number of Activities, which include but are not limited to trampoline, climbing walls, bounce track, super bikes, café access, as well as parties, classes and group sessions (“Activities”).

1.2 These are the terms and conditions which apply when you book to take part in an Activity with SuperPark.

1.3 Please ensure that you read these terms and conditions carefully, and check that the details of your booking are complete and accurate, before you submit your booking. If you think you have made a mistake, please contact SuperPark to discuss.

1.4 By submitting your booking, you agree that the supply of the Activities by SuperPark and your participation is subject to these terms and conditions.

1.5 No booking shall be deemed accepted unless and until it has been confirmed in writing by SuperPark, which will take the form of an email confirmation.

1.6 These terms and conditions also incorporate the terms of the SuperPark Participant Agreement / Risk Acknowledgement and Injury Waiver, and our Privacy Policy.

1.7 SuperPark reserves the right to revise these terms and conditions from time to time to comply with changes in any relevant laws or regulatory requirements.

2. Safety

2.1 Participation in the Activities is not without risk. You acknowledge that the Activities can be dangerous with many inherent risks and hazards, and that personal injury, and in rare cases fatality, can occur. All participants are required to sign a Waiver before taking part in any Activity, acknowledging and accepting these inherent risks.

2.2 Where an Activity involves trampolining, all participants must watch a safety briefing before every jumping session and must wear SuperPark grip socks.

2.3 After the safety briefing, participants will not be individually supervised by SuperPark team members.

2.4 Children under the age of 10 and people with special needs cannot participate unless accompanied by a parent, guardian, responsible adult or appropriate carer, who must remain on site. One adult may supervise a maximum of ten under-10-year-olds. SuperPark staff will not supervise children or anyone with special needs at any time. A parent, guardian, responsible adult or carer must sign the Waiver on behalf of any participant under 18 or who lacks capacity.

2.5 The Activities are physically demanding. All participants must be reasonably fit, in good health and free from any adverse medical condition. Participants are subject to the age and weight restrictions stated at the time of booking. The weight limit for an individual (fully clothed) participant is 120kg. If you have concerns, we recommend consulting your GP before participating.

2.6 Admission restrictions and contra-indications to safe participation include: excessive weight (see 2.5), circulatory conditions, heart or lung conditions, recent surgery, back or neck conditions, high blood pressure, spinal, musculoskeletal or head injury, Down’s Syndrome, disproportionate dwarfism, pregnancy and uncontrolled epilepsy. Customers with Down’s Syndrome should obtain GP or paediatrician screening (e.g. for Atlanto-Axial Instability) before taking part in trampolining Activities. Customers with disproportionate dwarfism should not take part in trampolining or repeated-jumping Activities. Customers with uncontrolled epilepsy should obtain GP approval, taking into account seizure type, frequency and known triggers, and should always be accompanied by someone aged 18+ who knows the condition.

2.7 Participants are advised to take part within their own ability. If pregnant, or if you have a heart condition or are wearing any form of plaster cast, you may not participate in any Activities. Participants are personally responsible for their own wellbeing.

2.8 Participants need to be able to see clearly enough to participate safely and/or to supervise anyone under 14 in their care; short- or long-sighted participants must wear contact lenses or prescribed glasses.

2.9 It is your responsibility to ensure everyone in your booking meets the above requirements. Anyone who does not will not be permitted to take part.

2.10 SuperPark reserves the right to refuse admittance to, or remove, any participant whose behaviour is considered unsafe, who does not comply with safety rules, or who is thought to be under the influence of alcohol or drugs. All participants must act responsibly and courteously. The decision of the Manager on Duty will be final.

2.11 Participants must be dressed appropriately; SuperPark reserves the right to refuse admittance to anyone who is not.

2.12 Participants must pay for any damage caused to the Facilities as a result of irresponsible, deliberate or reckless behaviour.

2.13 No refunds or compensation will be payable where a participant is not permitted to, or decides not to, take part in or complete an Activity for any reason.

3. Price and Payment

3.1 Our charges for all Activities and ancillary products (such as grip socks) are calculated at our current rates from time to time.

3.2 All charges include VAT and are quoted and payable in pounds sterling (£).

3.3 Payment must be made in full at the time of booking by debit or credit card.

3.4 SuperPark reserves the right to change its prices at any time; this will not affect Activities already booked and paid for in full before the change takes effect.

4. Cancellations, Transfers and Refunds

4.1 You may cancel your booking at any time. You have a 24-hour window from the point of payment (full or partial) in which you are entitled to a full refund. Cancellations made after this 24-hour period will only be offered a transfer to another date; no refund will be issued.

4.2 If you book a session scheduled for less than 24 hours from the point of payment, you are not entitled to a refund and may only move your booking or receive a credit note for the amount paid.

4.3 SuperPark may cancel your booking at any time; we will use reasonable endeavours to notify you as soon as possible and you will be entitled to a full refund, but no other compensation.

4.4 If an event outside SuperPark’s control occurs before your Activity which means we cannot provide it, your booking is refundable by way of a transfer to another date or a credit note redeemable at the same venue.

4.5 Payments made by debit or credit card will be refunded to the same card.

4.6 No refunds are given for transactions made using gift vouchers; bookings may be transferred in line with clauses 4.1, 4.2 and 4.4.

4.7 Where multiple forms of payment are used, SuperPark reserves the right to refund any monies due by debit or credit card.

4.8 The temporary unavailability of individual attractions, Activities or equipment (see clause 5.2) does not itself entitle you to a refund or compensation where SuperPark remains able to provide the booked session and a reasonable range of Activities.

5. Delivery of Service

5.1 We will provide the Activities to you at the SuperPark Glasgow venue, as set out in your booking confirmation email.

5.2 From time to time, certain attractions, Activities or equipment may be unavailable, restricted or closed for maintenance, repair, safety checks, technical faults or other operational reasons. SuperPark is not liable where this occurs, provided reasonable efforts are made to minimise disruption to your visit.

5.3 Any grip socks purchased online must be collected from the venue before taking part in the Activities.

6. Our Liability to You

6.1 Nothing in these terms and conditions is intended to exclude or limit any rights you may have as a consumer under applicable law.

6.2 SuperPark, its employees, directors and agents are not liable to you, your dependants or legal representatives for any indirect or consequential loss or damage, whether arising in contract, delict/tort (including negligence), statute or statutory duty, save that nothing in these terms and conditions limits SuperPark’s liability for death or personal injury caused by the negligence of SuperPark or its employees, agents or contractors, or affects your statutory rights as a consumer.

6.3 SuperPark is not responsible for loss or damage to your property or personal belongings during your visit. Personal possessions are brought onto the premises entirely at the owner’s own risk.

6.4 Where parking facilities are available on site, vehicles and their contents are left at the owner’s risk, subject to any conditions or fees required by the provider of those facilities.

6.5 Except as otherwise stated, any liability of SuperPark is limited to a refund of any charges paid to SuperPark.

6.6 To the maximum extent permitted by law, SuperPark is not liable for any injury, loss or damage arising directly or indirectly from the use of any arcade or other games machine owned or supplied by a third party.

7. Events Outside Our Control

7.1 SuperPark is not liable for any failure to perform, or delay in performing, its obligations under these terms and conditions caused by any act or event beyond its reasonable control.

7.2 If such an event affects performance of our obligations, we will contact you as soon as reasonably possible, and our obligations will be suspended for the duration of the event.

7.3 If such an event occurs before your Activity and means we cannot provide it, your booking is refundable by way of a transfer to another date or a credit note redeemable at the same venue.

7.4 If it becomes necessary to close the venue or cancel Activities for reasons beyond SuperPark’s control after your party has already begun participating, you will not be entitled to a refund (in part or whole). In such circumstances SuperPark may, but is not obliged to, offer alternative dates or times at reduced rates.

9. Other Important Terms

9.1 We may transfer our rights and obligations under these terms and conditions to another organisation; we will always notify you in writing if this happens, and it will not affect your rights or our obligations.

9.2 Nothing in these terms and conditions confers on any third party any benefit or right to enforce any of these terms.

9.3 Each paragraph of these terms and conditions operates separately. If any court or relevant authority decides that any of them is unlawful, the remaining paragraphs will remain in full force and effect.

9.4 If we fail to insist that you perform any of your obligations, or do not enforce our rights, or delay in doing so, this will not mean we have waived our rights, and will not mean you do not have to comply with those obligations. Any waiver by us will only be effective if given in writing, and will not mean we automatically waive any later default by you.
